Intructional broadcasting limitation (also known as the TEACH Act)

It is not an infringement of copyright when all of the following are fulfilled:

* an instructor (or another under the his/her direction) may:

-perform a nondramatic literary or musical work,
-perform a reasonable and limited portion of any other work, and/or
-display a copyrighted work in an amount comparable to that typically displayed in a classroom session

* during a transmission that:

-was made solely for students enrolled in a particular course; and
-the reception is (to the extent technologically feasible) limited to those students

* the performance or display is an integral part of a class session offered as a regular part of the systematic mediated instructional activities of this accredited nonprofit educational institution

* the performance or display directly relates to and is of material assistance to the teaching content of the transmission

* University policies exist regarding copyright; informational materials are provided to faculty, students, and relevant staff members that describe and promote compliance with the copyright laws; and students are notified that materials used in the course may be copyrighted works

* to the extent that would not interfere with technological measures used by copyright owners to accomplish the same purpose, the University uses technology

-to reasonably prevent retention of the work by students in accessible form for longer than the class session; and
-to prevent dissemination of the work in accessible form by the students to others

* such material stored on the University system or network is not maintained on such system or network in a manner to be ordinarily accessible to anyone other than anticipated recipients and copies of such material is not maintained on the system or network in a manner ordinarily accessible to such anticipated recipients for a longer period than is reasonably necessary to facilitate the transmissions for which it was made.

* the following are not used (1) a product that is itself produced or marketed for performance or display as part of mediated instructional activities transmitted via digital networks, (2) textbooks, course packs, or other materials typically purchased by students for their independent use and retention, or (3) an illegally made copy of the copyrighted work
