Limitations to copyright owner's exclusive rights

 

The limitations of the copyright owner’s exclusive rights are expressed in statutes and each limitation has a list of requirements that must be fulfilled in order to use that limitation. So, if you fulfill all the requirements of a particular limitation, it would not be an infringement to use the copyrighted work of another.

Some limitations related to the education environment are:

  1. Fair Use Doctrine (17 U.S.C. § 107);
  2. Face-To-Face Teaching (17 U.S.C. §110(1)); and
  3. Instructional Broadcasting (17 U.S.C.§ 110(2)).
