Addressing Allegations of Unlawful Discrimination.

 

The University provides the following procedures to address allegations of unlawful discrimination in an effort to provide a prompt and equitable resolution at the lowest appropriate level.

1. No Toleration of Unlawful Discrimination. Any person who, in good faith, believes he/she is a victim of unlawful discrimination or becomes aware of an incident of unlawful discrimination shall not tolerate such conduct.

a. “Tolerating” is to ignore, excuse, and/or allow to continue.

b. “Not tolerating” is to actively resist and reject the illegal behavior and to formally notify the appropriate University official in order to obtain a prompt and equitable resolution at the lowest appropriate level.

2. Notifying the Appropriate University Official. Notifications to the University:

a. should be initiated immediately and within 60 days of the alleged unlawful discriminatory incident or, in the case of a series of incidents, within 60 days of the most recent incident (notifications occurring after that time period will be received but resolution efforts might be hampered by the time delay)

b. must be to a member of the Equal Opportunity Oversight Committee (EOOC).

The EOOC will then exercise oversight responsibilities to ensure an investigation is conducted consistent with University policy.

3. Confidentiality.

a. Any information gathered in the resolution process (including any written report) is deemed confidential and may be released only on a need-to-know basis or as otherwise provided by law. Accordingly, such information should be safeguarded from inappropriate release and reports should be marked as confidential. If the written report or other documents form the basis for any contemplated punitive sanction, a copy of the relevant document may be provided to the person against whom the sanctions are contemplated in accordance with the existing relevant policies regarding that contemplated sanction.

b. Specifics regarding any punitive sanctions imposed are deemed confidential and may be released only on a need-to-know basis or as otherwise provided by law.
